As of March 31, 2026, Texas regulators tried to enforce new rules through the state health agency that would effectively ban the sale of smokable hemp products, including THCA flower. The key change was how the state defined "total THC": the new rules included THCA in that calculation, pushing previously compliant products over the 0.3% delta-9 limit.

But on April 11, Travis County District Court Judge Guerra Gamble issued a temporary restraining order pausing those rules for 14 days. The order came after a lawsuit filed by a coalition including the Texas Hemp Business Council (THBC) and Hemp Industry & Farmers of America (HIFA).

What the lawsuit argues

The core legal argument is a constitutional separation of powers issue. Texas lawmakers did pass a bill to severely restrict hemp products in the 2025 session,   but Gov. Greg Abbott vetoed it, and two special sessions also failed to enact a new law. Plaintiffs argue that regulators at DSHS and HHSC then tried to impose through rulemaking what the legislature couldn't pass through the proper process.

A hearing on a full temporary injunction is scheduled for April 23. If granted, the pause on enforcement could extend significantly further while the broader case plays out,  potentially reaching the Texas Supreme Court.
